DRY CULTURE PRIVACY NOTICE

Dry Culture wants you to be familiar with the kinds of personal information we collect from you online and offline, how that information is used and protected, with whom we share it, and the privacy rights and options you have with respect to your personal information.

This Privacy Notice describes how Dry Culture collect, use, and disclose your personal information through our websites from which you are accessing this Policy, our social media pages on third-party social media platforms, email, text, mail, and any offline business interactions you have with us (collectively, our “Services”).

By accessing or using our Services, you signify your acceptance of this Privacy Notice and consent to be bound by its terms. You can withdraw your consent at any time. We collect different types of information about you, including information that identifies, relates to, describes or can be associated with you (known as “personal information”), information that is about you but individually does not personally identify you, and information that we combine with our other users. This includes information that we collect directly from you or through automated collection technologies.

For the purposes of this Privacy Notice, the following are the specific types of personal information that we collect:

    • Postal address (including billing and shipping addresses);
    • Telephone number;
    • Email address;
    • IP address (we may also derive your approximate location from your IP address) or Media Access Control (MAC) address;
    • Account information, such as username and password;
    • Payment card data (however, please note that Dry Culture utilizes a third-party payment service for processing payment transactions, and does not store clear-text credit card number data);
    • Demographic information and other information provided by you that does not reveal your specific identity;=
    • Websites traffic data, location data, logs, referring/exit pages, date and time of your visit to our Services, error information, clickstream data, and other communication data and the resources that you access and use on the Services;
    • Information collected through cookies, pixel tags, and other technologies;
    • Information about your Internet connection, the equipment you use to access our Services and usage details; and
    • Any other personal information that you choose to provide to us through the Services.

If you disclose to us or to our service providers any personal information relating to other people in connection with the Services, you represent that you have the authority to do so and to permit us to use the information in accordance with this Privacy Notice.

 

4. DO WE COLLECT SENSITIVE PERSONAL INFORMATION?

Dry Culture does not ask you to provide, and we do not knowingly collect, any sensitive personal information from you (e.g., social security numbers, information related to racial or ethnic origin, political opinions, religion or other beliefs, health, biometrics or genetic characteristics, criminal background, or trade union membership). Unless we request it, we ask that you not send us, and you not disclose, any sensitive personal information on or through the Services or otherwise to us.

 

5. HOW DOES DRY CULTURE COLLECT YOUR PERSONAL INFORMATION?

We and our service providers collect personal information in a variety of ways, including:

Directly from You

We collect personal information you provide directly to Dry Culture, such as:

    • When you sign up to receive updates, special promotions, campaigns, or newsletters from us by text, email, or postal mail;
    • Respond to a survey;
    • Register an account to access the Services;
    • Contact customer service;
    • Place an order over the phone;
    • Make a purchase online; or
    • RSVP or attend one of our events.

Automatically Through Use of Our Website

    • Location Information. This Website collects real-time information about the location of your device. You can choose whether or not to allow the Website to collect and use real-time information about your device’s location through the device’s privacy settings. Providing Products and Services

We use your personal information to provide products and services, such as:

    • To provide the Services’ functionality to you, such as arranging access to your registered account.
    • To respond to your inquiries and fulfill your requests, when you contact us via one of our online contact forms, customer service or otherwise, for example, when you send us questions, suggestions, compliments, or complaints.
    • To fulfill your orders and/or complete your transactions, verify your information, and provide you receipts and order updates.

We use personal information for marketing and promotional purposes, such as to send you marketing-related emails, text messages, or postal mail, with information about our services, new products, campaigns, and other news about our company.

We will engage in this activity with your consent. If you consent to receiving marketing-related communications and/or materials from us, you will have the opportunity to opt-out (or unsubscribe) of the use of your personal information for marketing purposes. Analytics and Personalization

We use personal information to conduct research and analytics, including:

    • To analyze or predict our users’ preferences in order to prepare aggregated trend reports on how our digital content is used, so we can improve our Services.
    • To better understand your interests and preferences, so that we can personalize our interactions with you and provide you with information and/or offers tailored to your interests.
    • To better understand your preferences so that we can deliver content via our Services that we believe will be relevant and interesting to you.

We may provide you with personalized services and will use your personal information to assist us in providing you with such personalized services.

Allowing You to Participate in Sweepstakes, Contests, or Other Promotions

      • Identifying usage trends, for example, understanding which parts of our Services are of most interest to users;
      • Determining the effectiveness of our promotional campaigns, so that we can adapt our campaigns to the needs and interests of our users; and
      • Operating and expanding our business activities, for example, understanding which parts of our Services are of most interest to our users so we can focus our energies on meeting our users’ interests.

We disclose personal information for the purposes described below:

To Our Affiliates

We may share personal information with our corporate affiliates, including our parent company, and subsidiaries. Our affiliates include: Urban Surf, AXFIT Inc, Sketch Art Workshop, Raising Howells.

To Companies Engaged by Dry Culture

We may share your personal information with companies we engage to facilitate Services they provide to us. These can include providers of services such as website hosting, data analysis, payment processing, order fulfillment, information technology and related infrastructure provision, customer service, email delivery, auditing, and other services. These service providers may send you communications on our behalf. For more information on our third-party payment providers see Section 13 below.

To Our Third-Party Marketing Partners

We may share your personal information with our third-party marketing partners for marketing and advertising purposes. However, we do not share any information/data collected from the Short Message Service (SMS) program with third parties for marketing and advertising purposes.

To Third-Party Sponsors of Sweepstakes, Contests, and Similar Promotions

We may share your personal information with third parties that we have partnered with to jointly create and offer a product, service, or joint promotion. We do not share any information/data collected from the SMS program with third-party sponsors of sweepstakes, contests, and similar promotions. Some of these promotions have additional rules containing information about how we will use and disclose your personal information. Please read those additional rules before choosing to participate.

By Using the Services, You May Elect to Disclose Personal Information

On message boards, chat, profile pages, and other services to which you are able to post information and content (including, without limitation, our Social Media Pages). Please note that any information you post or disclose through these services will become public and may be available to other users and the general public. Please be careful with your personal information and make sure that any personal information that you share is material that you are comfortable being publicly viewable since neither you nor we can control what others do with your personal information once you share it publicly.

8. HOW DO WE KEEP YOUR PERSONAL INFORMATION SAFE?

We seek to use reasonable organizational, technical, and administrative measures to protect personal information within our organization. Unfortunately, no data transmission or storage system can be guaranteed to be 100% secure. If you have reason to believe that your interaction with us is no longer secure, please immediately notify us in accordance with the “Contact Us” section below.

 

9. TO WHAT COUNTRIES WILL YOUR PERSONAL INFORMATION BE TRANSFERRED?

 For the reasons and purposes set forth in this Privacy Notice, personal information may be collected, used, stored, disclosed, and otherwise processed outside of your jurisdiction of residence, including in any country where we have facilities or in which we engage service providers. Specifically, we may disclose your personal information to entities located outside of Canada, including to the following:

    • Our related bodies corporate, located in the United States, Australia, New Zealand, United Kingdom, and European Union; and
    • Our data hosting providers, other IT service providers and/or other third parties, located in Australia, New Zealand, Japan, Philippines, and the United States.

By using the Services you understand and agree that your personal information will be transferred to countries outside of your country of residence, including to the United States, which may have data protection rules that are different from those of your country. You acknowledge and agree that in certain circumstances, courts, law enforcement agencies, regulatory agencies or security authorities in those other countries may be entitled to access your personal information.

 Consistent with applicable law, you may exercise any of the choices and rights described in this section. Some rights may vary depending on your country, province, territory, or state of residence. Managing Communication Preferences

We will obtain your consent prior to sending you any marketing-related emails, text messages, or postal mail, unless an exception to obtaining your prior opt-in consent applies under applicable law. You may opt-out or unsubscribe from receiving marketing-related communications from us at any time by using the opt-out mechanism contained in each such communication, or you may contact us in accordance with the “How Can You Contact Dry Culture?” section below. We will try to comply with your request(s) as soon as reasonably practicable, and in any case, within the time period required under applicable law. Please note that if you opt-out of receiving marketing-related communications from us, we may still send you important administrative messages, from which you cannot opt-out. For example, when you create an account, reset your password, or complete a transaction you will receive an email confirming the details of such activity for your records.

Access, Correct or Update Your Personal Information

If you would like to request to access, correct or update your personal information, you may contact us in accordance with the “How Can You Contact Dry Culture?” section below. We will respond to your request consistent with applicable law. Please note that we may ask you to verify your identity and request before taking further action on your request.

    • Access. You may have the right to request access to or copies of the personal information Dry Culture holds about you, including how it is or has been used, and any organizations to which it has been disclosed.
    • Correct or Update. You may have the right to correct or amend any personal information that is shown to be factually inaccurate or incomplete, and when appropriate, transmit the amended information to any parties to whom you may have sent the original information. In your request, please make clear what personal information you would like to have changed. Additionally, you can review and change your personal information by logging into the Services and visiting your “My Account” page. This includes first name, last name, company, address, and phone number when securely logged in.

Your right to access, correct or update your personal information is not absolute. There are circumstances where applicable law or regulatory requirements allow or require us to refuse to provide you with some or all of the personal information that we hold about you. In addition, the personal information may have been destroyed, erased, or made anonymous in accordance with our record retention obligations and practices. In the event we cannot provide you with access to your personal information, we will endeavour to inform you of the reasons why, subject to any legal or regulatory restrictions.

Like many websites, Dry Culture uses cookies to analyze visits to our Website and help us improve our Website and Services. Most browsers accept cookies automatically. However, if you disable or refuse cookies, please note that some parts of this site may then be inaccessible or not function properly.

We do not control third parties’ collection or use of your information to serve interest-based advertising. You can also opt-out of receiving targeted ads from members of the NAI on its website.

Withdraw Consent

To the extent that our processing of your personal information is based on your consent, you may withdraw your consent at any time, subject to legal or contractual restrictions and reasonable notice. Withdrawing your consent will not, however, affect the lawfulness of the processing based on your consent before its withdrawal, and will not affect the lawfulness of our continued processing that is based on any other lawful basis for processing your personal information.

 

11. HOW LONG DO WE KEEP YOUR PERSONAL INFORMATION?

We do not keep your personal information forever. We will keep your personal information for as long as it is reasonably needed to fulfill the purpose(s) for which it was collected, provide our Services, resolve disputes, establish legal defenses, enforce our agreements, or as required by applicable law.

 

12. DOES THIS PRIVACY NOTICE APPLY TO THIRD-PARTY SITES? 

No. This Privacy Notice does not apply to information collected by third-party websites that may be accessible through the Services. This Privacy Notice does not address, and we are not responsible for, the privacy, information, or other practices of any third parties, including any third party operating any website or service to which the Services link. The inclusion of a link on the Services does not imply endorsement of the linked site or service by us or by our affiliates.

In addition, we are not responsible for the information collection, use, disclosure, or security policies or practices of other organizations, such as Facebook, Apple, Google, Microsoft, RIM, or any other social media platform provider, operating system provider, wireless service provider, or device manufacturer, including with respect to any personal information you disclose to other organizations through or in connection with our Social Media Pages.

 

13. DOES DRY CUYLTURE USE A THIRD-PARTY PAYMENT SERVICE?

We use a third-party payment service to process payments made through the Services. If you wish to make a payment through the Services, your personal information will be collected by such third party and not by us and will be subject to the third party’s privacy notice, rather than this Privacy Notice. We have no control over, and are not responsible for, this third party’s collection, use, and disclosure of your personal information.

 

14. USE OF SERVICES BY MINORS?

The Services are not directed to minors, and we do not knowingly collect personal information of minors. If you believe that we have collected the personal information of a minor, please let us know.

 The “LAST UPDATED” legend at the top of this Privacy Notice indicates when this Privacy Notice was last revised. Any changes will become effective when we post the revised Privacy Notice on the Services. We will notify you if the notice changes in any material way by placing a prominent notice on our website.
